What is the difference between physical and legal custody?
Pennsylvania has both no-fault and fault-based divorce. An uncontested no-fault divorce after a 90-day waiting period can resolve in a few months. A contested divorce involving property division, custody, or support can take a year or more. We will give you a realistic estimate for your specific situation at the consultation.
In general, anything acquired during the marriage, regardless of whose name is on it. Some assets, including inheritances, gifts to one spouse, and property owned before the marriage, may be excluded. Pennsylvania is an equitable distribution state, which means the division is not automatically 50/50. The court considers the length of the marriage, contributions of each spouse, and other statutory factors.

Pennsylvania has spousal support (during the marriage), alimony pendente lite (during the divorce), and alimony (after the divorce). Whether alimony applies depends on the length of the marriage, the income of each spouse, earning capacity, and other factors. We will walk you through the math at the consultation and explain what the court is likely to consider.
