DO I NEED ESTATE PLANNING?

All adults should have a health care power of attorney/living will, a power of attorney, and a last will and testament!

  • If you already have these important documents and they no longer reflect your wishes to due a death, birth, divorce, children growing up, or other life changing event, you should update them.   

HOW CAN I GET A WILL IF THE LAW OFFICES ARE CLOSED?

  • Although our physical office is closed, McMahon Winters Strasko is open for business and we are working remotely.  
  • We can provide advice by phone and email, and also provide you with draft and final documents. 

DO I NEED TO FIND A NOTARY?

  • A Health Care Power of Attorney/Living Will is not required to be notarized; but, it does need witnesses.  
  • A Last Will and Testament is not required to be notarized, but make sure you have contact information for witnesses as they will need to be available to the Register of Wills in the event your will is admitted to probate.  Signing before a notary and witnesses is still the easier and preferred method. 
  • A Power of Attorney does need to be to be witnessed and notarized, but if you sign with your attorney, they can attest to your signature if we have a copy of your driver’s license.

  • Communicate with those in your life about your wishes.  
  • Complete a funeral planning and document checklist. We can email these documents to you for free! Just contact us at jparrish@mcmahonwinters.com or kkiousis@mcmahonwinters.com  
  • Make sure your online account information, including user id and passwords, are organized and obtainable to your executor/agent in the event of an emergency.
